Initial quotes are considered preliminary unless explicitly stated as a fixed-price contract. Final pricing may be adjusted if site conditions change, material availability shifts, or you request additional features. We will always obtain your written or verbal approval before proceeding with any scope changes that affect the budget. You are responsible for ensuring that the information you provide about your property (dimensions, slope, existing structures, utility locations) is accurate. Inaccurate information may require us to revise the estimate and timeline.

5. Payment Terms & Billing

We believe in fair, straightforward payment structures that align with project milestones:

  • A non-refundable deposit is required to secure your project date and order materials. The deposit amount will be clearly outlined in your project agreement.
  • Progress payments are typically scheduled at key installation phases (e.g., after base preparation, after paver/turf installation, after final grading and cleanup).
  • Final payment is due upon substantial completion and your walk-through approval, unless otherwise agreed in writing.

We accept checks, credit/debit cards, and electronic bank transfers. Late payments may incur a standard service fee, and we reserve the right to pause work until outstanding balances are settled. All prices are quoted in U.S. dollars and do not include unexpected permit fees, homeowners association (HOA) review costs, or specialized inspections unless explicitly included in your contract.

6. Scheduling, Weather & Project Timelines

Florida weather is beautiful but unpredictable. Heavy rain, tropical storms, extreme heat, or lightning can safely delay outdoor construction. We build reasonable weather buffers into our schedules, but we cannot guarantee exact completion dates. If weather, supply chain delays, or permitting holdups push your timeline back, we will communicate proactively and adjust accordingly.

Project start dates are estimates based on our current workload and material lead times. We’ll confirm your schedule in writing once your deposit is received and materials are secured. We ask for your patience and flexibility, as rushing outdoor construction in poor conditions can compromise drainage, base stability, and long-term durability, something we never want to risk.

7. Your Responsibilities as the Client

To ensure a smooth, efficient project, we ask that you:

  • Provide clear, safe access to the work area for our crew, equipment, and material deliveries.
  • Remove personal items, furniture, decorations, vehicles, and pets from the work zone before we arrive.
  • Notify us in advance of any underground sprinkler lines, gas lines, septic tanks, or private utility markers.
  • Secure any required HOA approvals, architectural review permissions, or local permits before work begins (unless we’ve explicitly agreed to handle permitting on your behalf).
  • Be available or designate a point of contact for daily check-ins, especially if decisions are needed mid-project.

If access is blocked, approvals are delayed, or site conditions change without notice, we may need to reschedule or pause work. Additional costs resulting from client-caused delays will be discussed and billed accordingly.

8. Change Orders & Scope Adjustments

We understand that ideas evolve. If you’d like to add a fire pit, expand a patio, switch paver styles, or adjust plant selections after work has started, we’ll gladly accommodate your vision through a formal change order. Change orders will outline the updated scope, adjusted pricing, and revised timeline. Work on the new additions will only begin once the change order is approved and any additional deposit is processed.

Please note that mid-project changes may delay completion, especially if specialized materials need to be ordered or if crew scheduling requires adjustment. We always aim to minimize disruptions while honoring your updated preferences.

9. Warranties, Guarantees & Plant Health

We stand behind our craftsmanship. Hardscaping installations (pavers, walls, driveways) come with a manufacturer-backed warranty and our own workmanship guarantee, typically covering settling, shifting, or installation defects for a period specified in your contract. These warranties do not cover damage caused by heavy vehicle traffic, improper drainage, natural ground movement, tree root intrusion, or Acts of God (including hurricanes, flooding, or severe storms).

Plant material and natural sod carry a 30-day establishment guarantee, provided you follow our watering, fertilization, and care instructions. Florida’s climate, soil composition, irrigation consistency, and seasonal changes heavily influence plant survival. We cannot guarantee longevity if irrigation systems fail, drainage is inadequate, or maintenance guidelines are not followed. Artificial turf installations come with manufacturer warranties covering UV fading, seam separation, and infill displacement under normal residential or light commercial use.

All warranties require regular maintenance and may be voided by unauthorized repairs, improper cleaning chemicals, or modifications made by third-party contractors.

10. Limitation of Liability & Risk Allocation

While we take every precaution to protect your property and deliver flawless results, landscaping and hardscaping inherently involve heavy equipment, excavation, and material handling. By engaging our services, you acknowledge that minor cosmetic scratches on driveways, temporary lawn compression, or dust/debris during installation are normal and will be addressed during final cleanup.

Ideal Landscapes and Hardscaping shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of property value, temporary relocation costs, or business interruption. Our total liability shall never exceed the total amount paid for the specific service in question. We strongly recommend verifying your homeowner’s or business insurance coverage before beginning outdoor construction.

11. Intellectual Property & Use of Our Work

All designs, sketches, 3D renderings, project plans, and written proposals created by Ideal Landscapes and Hardscaping remain our intellectual property. You are granted a personal, non-transferable license to use these materials solely for your project. Reproducing, reselling, or distributing our designs for other contractors or properties without written permission is strictly prohibited.

With your consent, we may photograph or video record completed projects for our portfolio, website, social media, and marketing materials. We will never share your full address or personal contact information publicly. If you prefer your property remain private, simply let us know before we begin, and we will gladly respect your wishes.

We do not offer partial refunds for completed phases that meet quality standards. If we determine that a project cannot be completed safely or ethically due to site conditions, non-cooperation, or non-payment, we reserve the right to terminate the agreement with written notice. In such cases, you will be billed for all work completed and materials used up to the termination date.

If we cannot reach a mutual resolution, both parties agree to participate in good-faith mediation before pursuing legal action.

These Terms and all services provided by Ideal Landscapes and Hardscaping are governed by the laws of the State of Florida. Any legal proceedings shall be filed in the appropriate courts serving Hillsborough, Pinellas, or Pasco Counties, depending on your property location.
